Welcome to Peak Strategy Systems LLC. These Terms of Service ("Terms") govern your access to and use of our website, proprietary Playbook materials, and membership tiers (the "Services"). By enrolling in any tier or accessing our materials, you agree to be bound by these Terms.
1. Scope of Services & Membership Tiers
Peak Strategy Systems LLC provides access to proprietary outreach frameworks, scripts, and strategic consulting via three membership levels: Standard, Professional, and Executive. Access is granted via a "Systems Access" subscription model, managed through our third-party provider, MemberSpace.
2. Fees and Recurring Billing - Subscription Basis:
Services are billed on a recurring monthly or annual basis, depending on the plan selected at enrollment.
Billing Frequency & Differentiation: Peak Strategy Systems LLC offers two billing cycles: Monthly and Annual. Monthly plans provide short-term flexibility with a recurring charge every 30 days. Annual plans are structured as a long-term commitment, requiring a single upfront payment for a twelve-month period in exchange for a 20% discount on the total service fee.
Annual Plan Discount: Annual plans are billed as a single upfront payment of $1,910.40 (Standard), $3,350.40 (Professional), or $4,790.40 (Executive), providing a 20% discount compared to the cumulative monthly rate (Annual and Monthly Plan Prices subject to change).
Automatic Renewal: Your membership will automatically renew at the conclusion of your respective billing period—either every month or every twelve months—on the anniversary of your initial enrollment date unless canceled in accordance with Section 3.
Payment Authorization: By providing payment information, you authorize Peak Strategy Systems LLC to charge the applicable fee for your selected tier and chosen billing frequency.
3. Cancellation and Refund Policy
You may cancel your membership at any time through your member portal.
Billing Cycle Completion: Upon cancellation, you will retain access to the Services until the end of your current billing cycle (the remainder of the month for monthly plans or the remainder of the year for annual plans).
No Refunds on Annual Plans: Due to the 20% discount provided and the immediate delivery of high-value digital assets, all annual sales are final. No partial or prorated refunds will be issued for mid-year cancellations. Following cancellation, the plan will remain active until the 1-year anniversary and will not renew.
No Refunds on Digital Assets: Due to the immediate, downloadable nature of "The Playbook" and proprietary scripts, all sales are final. Peak Strategy Systems LLC does not offer refunds once access to the member portal has been granted.
4. Intellectual Property & Limited License
Proprietary Rights: All scripts, frameworks, videos, and Playbook materials are the sole intellectual property of Peak Strategy Systems LLC.
Non-Transferable License: Your membership grants you a personal, non-exclusive, non-transferable license to use these materials for your own professional development or internal business use.
Prohibited Use: You are strictly prohibited from reselling, redistributing, or sharing access to the member portal or any proprietary scripts with non-members. Violation of this clause will result in immediate termination of access without refund and potential legal action.
No Work-Made-For-Hire: The use of proprietary scripts in your outreach does not constitute a transfer of Intellectual Property. No 'work-made-for-hire' relationship is created, and all underlying frameworks remain the exclusive property of Peak Strategy Systems LLC.
5. Disclaimer of Results (Earnings & Sales Disclaimer)
Educational Purpose: The information, scripts, and frameworks provided are for educational and advisory purposes only. They do not constitute legal, financial, or professional business advice.
No Guarantee of Results: Peak Strategy Systems LLC does not guarantee specific sales outcomes, revenue increases, or successful partnership closures. Any testimonials or examples are illustrative and do not constitute a promise of future performance.
Individual Effort: Success depends on various factors, including individual implementation, market conditions, and the user's specific industry. Our frameworks are offered as a tool to support your efforts, not a guaranteed result.
Professional Relationship Disclaimer: Use of these systems does not create a fiduciary, professional, or employment relationship between you and Peak Strategy Systems.
Hold Harmless & Limitation of Liability: You agree to hold Peak Strategy Systems harmless from any and all claims, suits, or damages arising out of your outreach activities. Our total liability is limited to the fees actually paid by you for your subscription during the preceding twelve-month period.
Compliance Responsibility: Users are solely responsible for ensuring their use of these scripts complies with all local and international laws, including the CAN-SPAM Act and third-party terms of service (e.g., LinkedIn’s User Agreement).
Intellectual Property Rights: All content, including "The Playbook" and Monday Morning updates, is the proprietary property of Peak Strategy Systems. Access is granted for individual use only; reproduction, distribution, or commercial resale of these materials is strictly prohibited.
Assumption of Risk: You voluntarily assume all risks associated with the implementation of these strategies, including but not limited to the risk of account suspension or reputational harm resulting from outreach activities.
6. Limitation of Liability
To the maximum extent permitted by law, Peak Strategy Systems LLC shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our frameworks or services.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which Peak Strategy Systems LLC is registered.
To maintain a high professional standard, the Privacy Policy is typically its own distinct legal document rather than a bullet point within the Terms of Service. However, if you want to include a summary section within your Terms to address how data is handled, you can add this 8th section:
8. General Clauses
Termination for Cause. Peak Strategy Systems LLC reserves the right to terminate access to the Services immediately, without notice or refund, if a member engages in behavior that is deemed harmful to the community, harassing toward staff, or in violation of the spirit of the implementation masterclasses.
Modifications to Services. We reserve the right to modify, update, or discontinue any specific component of the Playbook or membership tiers at any time to ensure the frameworks remain relevant to current market conditions.
Indemnification. You agree to indemnify and hold harmless Peak Strategy Systems LLC from any claims, damages, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
Entire Agreement. These Terms constitute the entire agreement between you and Peak Strategy Systems LLC regarding the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
9. Dispute Resolution and Binding Arbitration
Mandatory Arbitration: You and Peak Strategy Systems LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be settled by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration Process: The arbitration will be conducted in Hampshire, Illinois, or another mutually agreed location. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other or decided on a class-action basis.
Costs of Arbitration: Each party will be responsible for their own legal fees, and the costs of the arbitrator will be shared equally, unless the arbitrator determines the claim was frivolous.
PRIVACY POLICY

3. Data Retention
Active Membership: We retain your personal data for the duration of your active membership to provide uninterrupted access to the Services.
Compliance Retention: Following the cancellation of your membership, Peak Strategy Systems LLC retains your records (name, email, and billing history) for a period of three (3) years to satisfy tax, audit, and legal compliance obligations.
4. Data Subject Rights & Opt-Outs
Access and Deletion: You have the right to request access to or deletion of the personal information we hold about you.
Email Opt-Out: You may opt out of non-essential communications (such as marketing or new framework alerts) at any time by clicking the "Unsubscribe" link in our emails or by contacting Joseph.Lazar@peakstrategysystems.com.
5. Third-Party Platforms
Service Providers: We use third-party providers, specifically MemberSpace for membership management and Stripe for payment processing.
External Links: Our site may contain links to external sites (such as Amazon for book purchases). We are not responsible for the privacy practices or content of these third-party platforms.
Third-Party Data Processing: We share limited personal data with the following essential sub-processors to provide the Services: MemberSpace (Access Management), Stripe (Payment Processing), Zapier (Executive Scorecard Automation), and Squarespace (Web Hosting).
6. Cookies and Tracking Technologies
Analytics: We use cookies and similar tracking technologies via Squarespace Analytics to monitor site traffic and performance. By using our site, you consent to this non-identifying data collection.
